Orphan Works Bills Hit House, Senate

Last week, new orphan-works bills were filed in both the House of Representatives (H.R. 5889) and the Senate (S. 2913). The American Society of Media Photographers has endorsed the House version of the bill, while characterizing the Senate bill as needing improvement. The House bill includes several important provisions, such as mandating a notice of use of an orphan work to be filed with the U.S. Copyright Office, requiring reasonable compensation in cases where a copyright owner steps forward and limiting allowed orphan-works uses, for example, on coffee mugs or T-shirts. The bill also mandates the Copyright Office to facilitate the development of a database that would allow cataloguing orphan works.
