Inspiration Becomes Plagiarism

At the heart of the currently pending Psihoyos v. Apple is whether shooting an entirely new image can be considered copyright infringement. The topic of legally actionable plagiarism is not new for the stock industry; this year alone has yielded several legal decisions dealing with the line between inspiration and infringement. Getty Images just won such a lawsuit in France, where one of its stock images was copied for an ad campaign for the country's tourism association. Editorial Photographers of the U.K. and Ireland has summarized this and other similar cases from the last two decades in Visual plagiarism: when does inspiration become imitation?
