“Getty’s RF ‘Market Freeze’: Expensive Customer Mess?" I received the following clarifying message from Matthew McKibben, Getty Images, PR Manager in The Americas. He said:
"When issuing a Market Freeze license—which can’t be purchased on the Getty Images or iStock websites—our sales representatives work closely with our customers to ensure they understand exactly what they are purchasing.
"As part of the sales process, we are very clear with customers any market freeze will not impact any prior licenses granted to the asset. We also make sure the customers knows if the image is exclusive to Getty Images, or, if it is potentially available via other platforms. In the latter, we will work with the content creator to offer full exclusive licensing or we will present the customers with alternative images where we can offer full exclusivity.
"Additionally, as you note in the article, the license does not guarantee full exclusivity, only that the content will be pulled from our sites moving forward for an agreed upon period of time."
